These Terms of Service (“Terms”) govern your access to and use of the MAX MD Medical Aesthetics + Wellness website and related online services (collectively, the “Site” or “Services”). By accessing or using our Site, you agree to these Terms. If you do not agree, do not use the Site.

2) NO MEDICAL ADVICE

The Site is provided for general informational and educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.

  • Content on the Site does not establish a provider–patient relationship.
  • Do not disregard or delay seeking medical advice because of something you read on the Site.
  • In an emergency, call 911 or go to the nearest emergency room.

Treatment outcomes vary by individual. Any before-and-after images, testimonials, or examples are not guarantees of results.


3) ELIGIBILITY

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site. If you are using the Site on behalf of another person or entity, you represent that you have authority to bind them to these Terms.


4) APPOINTMENTS, BOOKING, AND THIRD-PARTY SERVICES

The Site may allow you to request or schedule services through a third-party booking platform (such as Vagaro or similar providers). Your use of any third-party platform is subject to that provider’s own terms and policies.

  • Appointment requests are not guaranteed until confirmed by MAX MD.
  • We may refuse, cancel, or reschedule appointments in our discretion, including for safety, clinical, or administrative reasons.
  • You are responsible for providing accurate information when booking or submitting forms.


5) PAYMENT, CANCELLATIONS, AND NO-SHOWS

Payment policies, deposits, cancellation windows, and no-show fees (if applicable) may be communicated during booking, intake, or at the time of service. You agree to comply with the policies provided to you in connection with your appointment.


6) COMMUNICATIONS CONSENT

By submitting forms, requesting an appointment, or contacting us, you consent to receive communications from MAX MD related to your inquiry, scheduling, care coordination, and administrative messages via email, phone, or SMS—consistent with your preferences and applicable law.


7) SMS PRIVACY POLICY & TERMS OF SERVICE

MAX MD Medical Aesthetics + Wellness may use SMS text messaging to communicate with clients regarding appointment confirmations, appointment reminders, scheduling assistance, and responses to client-initiated inquiries.

By providing your phone number and opting in through our website form or intake forms, you consent to receive SMS messages related to your inquiry, appointments, and care.

  • Message frequency varies.
  • Message and data rates may apply.
  • You may opt out at any time by replying STOP. Upon opting out, you will receive a confirmation message stating that you will receive no further SMS messages. You may reply START to re-subscribe.

  • MAX MD Medical Aesthetics + Wellness does not send promotional marketing messages under this SMS program.
  • Customer information, including phone numbers, is not sold, rented, or shared with third parties for marketing purposes.

8) ACCEPTABLE USE

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to the Site, servers, or systems
  • Interfere with the Site’s functionality, security, or availability
  • Upload or transmit viruses, malware, or harmful code
  • Use automated scraping or data-mining tools without our permission
  • Submit false, misleading, or impersonating information through Site forms

We may suspend or terminate access to the Site for violations of these Terms.

10) TESTIMONIALS AND RESULTS DISCLAIMER

Testimonials reflect individual experiences and opinions and do not guarantee that you will achieve the same results. Cosmetic and medical aesthetic results depend on many factors including anatomy, skin condition, treatment plan, and aftercare adherence.


11) WEBSITE CONTENT ACCURACY

We work to keep Site content accurate and up to date, but we do not warrant that the Site will be error-free, uninterrupted, or that information will always be current. We may update or remove content at any time without notice.


12) DISCLAIMER OF WARRANTIES

13) LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAX MD AND ITS PROVIDERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR SERVICES.

IN NO EVENT WILL MAX MD’S TOTAL LIABILITY EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID TO MAX MD FOR THE SPECIFIC ONLINE TRANSACTION GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER, UNLESS APPLICABLE LAW REQUIRES OTHERWISE.


14) INDEMNIFICATION

You agree to defend, indemnify, and hold harmless MAX MD and its affiliates, providers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of another.


15) PRIVACY

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and share information.


16) GOVERNING LAW / VENUE

These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles. Any dispute arising under these Terms shall be brought in the state or federal courts located in Nassau County, New York, unless applicable law provides otherwise.


17) CHANGES TO THESE TERMS

We may update these Terms from time to time. The “Last Updated” date above indicates when changes were last made. Your continued use of the Site after any update constitutes acceptance of the revised Terms.
